BELLINGHAM, WA (MyBellinghamNow.com) – Apartment owners near Bellingham’s Walmart encampment have formally asked a judge to speed up the cleanup process.

The owner of Tullwood Apartments filed a motion on August 2 to request a summary judgement in the case involving encampment property owner Li-Ching Fang of Taiwan. The apartment’s attorney claims that it would make more sense to issue a ruling based on law instead of trying the facts of the case.

The attorney added that a recent Supreme Court decision gives cities the authority to take necessary action and clear the encampment on their own.

Fang was served with the lawsuit by the City of Bellingham in February 2024. She hired nuisance abatement specialists for her property in March, but they haven’t cleared the encampment or offered any information on a proposed site assessment from early May.

No legal correspondence from Fang has been submitted to the court since March.

Tullwood’s owner joined as an additional party in June. Their attorney claims that at least half a dozen residents have moved out due to conditions at the encampment.

A court date for a judge to rule on a summary judgement has been scheduled for September 5.
