92.9 KISM is going to help you Pick Your Patio!

Listeners can become a finalist for the Pick Your Patio prize pack multiple ways.

Each weekday between February 3rd, 2020 and March 7th, 2020 once a day a cue to call will play. The 9th caller at 360-733-5476 will become a finalist. If, for any reason, caller 9 is disconnected, we will move onto caller 10, caller 11, etc., in succession until we find a finalist.

Listeners can also register to become a finalist at any of the registration events held by contest sponsors. These sponsors will each have one event: Judd and Black in Bellingham, E&E Lumber in Sedro-Woolley, Wilson’s Furniture in Ferndale and one final event during the Home Show at the Lynden Fairgrounds.

To qualify they must give their full name, date of birth, city of residence and phone number and put it in the available entry box. At the end of each event except for the Whatcom County Home and Garden Show, 5 names will be randomly selected by KISM staff and each person will be notified via phone that they are a finalist for Pick Your Patio. There will be only two attempts to notify finalists should they not answer on the first attempt. There will be 10 names randomly selected by KISM staff for the Whatcom County Home and Garden Show and they will not be contacted to be notified that they are a finalist.

There will be a total of approximately 25 on-air finalists, and 25 remote finalists for a possible 50 finalists at the end of the contest.

Listeners can only qualify once, and only one qualifier per household. Dates and times of registration events will be promoted on KISM and posted at www.KISM.com three days in advance of the event.

Entries will be accepted between the start and end time of the registration event. Once the event is over, no additional entries can be submitted until the next registration event date/time that is available at KISM.com. One entry per person. If, for some reason, an entry is found to be ineligible, it will be disqualified and a new, alternate finalist may be drawn.

One winner will be selected randomly by KISM staff out of all the finalists gathered between February 3rd and March 7th, 2020. The name drawn from the pile will be chosen at approximately 7:10am on March 9th and announced on air immediately following the drawing. The person whose name was announced has 10 minutes to call 360-733-5476 to claim their prize. If that person does not call within the time frame, they will be disqualified from winning and a new name will be chosen and announced on air. The same process will happen until somebody wins, or it reaches 9am. If there is no winner by 9am, one last name will be drawn and KISM staff will notify them via phone that they have won the Pick Your Patio prize pack. Finalists do not need to be present to win

The winner will be chosen in the sole discretion of KISM. You may only qualify one time. Submitting more than one entry per person will invalidate all entries by that contestant. Any entry submitted using another person’s email address or name will be disqualified and ineligible to claim any prize.  Any attempt by any participant to obtain more than the stated number of entries allowed by using same, multiple/different email addresses, identities, or any other methods void that participant’s entries and that participant may be disqualified. In the event of a dispute as to any on-line registration, the authorized account holder of the e-mail address used to register will be deemed to be the registrant and he/she must be eligible according to these Official Rules. No mechanically reproduced or automated entries permitted.  Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void. Any entries containing obscene or offensive materials will be disqualified and will be deemed void.

The prize pack consists of various supplies from contest sponsors to help the winner build a new patio including:

  • A Traeger Ironwood 650 grill valued at $1,199 and a Danby Dual-Tap Kegerator valued at $819 from Judd & Black
  • $2,000 gift card to E&E Lumber for lumber and building supplies
  • $2,000 in construction labor including bid to build a deck. Winner must cover expenses over and beyond the $2,000 supplied by North Sound Services
  • A pub dining set with a fire pit table and chairs from Wilson’s Furniture valued at $2,500 approximately
  • $750 in bark from Lenz Enterprise

Prize pack total retail value is approximately $9,268. Prize value based on retail value, as stated by the contest sponsor.

No purchase necessary. KISM’s Sole responsibility will be to gift the prize. KISM will have no further responsibility in connection with the prize if the prize winner, for any reason, cannot or decides not to use any of the prizes. Winners will be responsible for all federal and state taxes, and any fees and incidentals. Prizes are not transferrable or redeemable for cash.

To submit an entry, you must provide all applicable contact information during the registration process. KISM contests are open to all eligible Washington state residents, age 18 or older, that have not won anything on KISM in the past 30 days or any prize valued at $600 or more in the past 6 months. Only one winner per household is permitted within 30 days after a household has a winner. Any prize awarded to an ineligible listener will be deemed null and void, and an alternate eligible winner may be named.

Employees of KISM, Saga Broadcasting, LLC dba Cascade Radio Group, and its ultimate parent company, Saga Communications, Inc., their advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one-hundred-mile radius of the KISM main studio are not eligible to win any contest.  Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This also includes individuals for whom the employee is current legal guardian.

We will make reasonable efforts to award prizes within 30 days.

These are the rules governing all contests aired on Classic Rock 92.9 KISM radio and on the kism.com website or Classic Rock 92.9 KISM mobile app, unless otherwise specified. In the following rules, “Classic Rock 92.9 KISM” means Pacific Northwest Media Group, which owns Classic Rock 92.9 KISM radio:

  1. No purchase is necessary to enter any Classic Rock 92.9 KISM contest.
  2. To be eligible to win any prize on Classic Rock 92.9 KISM you must not have won anything on Classic Rock 92.9 KISM in the past 30 days or any prize valued at $600 or more in the past 6 months. Only one winner per household is permitted within 30 days after a household has a winner. Any prize awarded to an ineligible listener will be deemed null and void, and an alternate eligible winner may be named.
  3. Anytime you call the Classic Rock 92.9 KISM studios you assume that your call will be broadcast or recorded and you grant us permission to broadcast the call or record it for later broadcast.
  4. As a winner of a Classic Rock 92.9 KISM contest your voice, name and/or picture may be used for promotional, broadcast, or internet purposes without any compensation to you.
  5. Prizes awarded are not redeemable for cash. No prize is transferable. No substitution for a prize will be made at the request of winner. Classic Rock 92.9 KISM reserves the right to substitute a prize of similar value.
  6. All winners of all contests are responsible for all taxes on prize awarded. All winners of a prize valued at $600 or more will be required to complete the appropriate tax forms at the Classic Rock 92.9 KISM studios prior to claiming prize. All winners will be sent a 1099 MISC federal tax form if in one calendar year the prize value of all prizes won exceeds $600.
  7. In the event the winner is subject to or the subject of any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), Classic Rock 92.9 KISM’s delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as (Classic Rock 92.9 KISM) awarding the prize to the winner. Classic Rock 92.9 KISM shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. Classic Rock 92.9 KISM shall not be liable for any claim by any winner for damages incidental thereto.
  8. All Classic Rock 92.9 KISM contests are open to all eligible residents 18 or over (unless otherwise specified) living within 75 miles of station transmitter(s). Contestants must possess a valid form of identification bearing the picture of the contestant acceptable to Classic Rock 92.9 KISM that will be presented to Classic Rock 92.9 KISM and accepted before the prize is awarded. Employees of Classic Rock 92.9 KISM, it's advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one hundred mile radius of the Classic Rock 92.9 KISM main studio are not eligible to win any contest. Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and their spouse. This also includes individuals for whom the employee is current legal guardian.
  9. Winners will be expected to claim prize at the Classic Rock 92.9 KISM studios, 2219 Yew Street Road, Bellingham, Washington 98226, between 12:00pm – 5:00pm, Monday through Friday (excluding holidays) within 30 days of being notified that they are winners, unless there is an expiration date on prize, which will be specifically stated.
  10. Where the prize(s) consists of paper tickets (“will-call tickets”) the winner will be directed to go to a specified address and retrieve the will-call tickets, and, by entering the contest, the contestant agrees to pick up will-call tickets and sign and deliver to Classic Rock 92.9 KISM a waiver form as directed. Where the prize(s) consists of electronic (digital) concert or event tickets (“e-tickets”), the winner will receive an email from Classic Rock 92.9 KISM with a hyperlink to an electronic waiver form that the winner must sign and return to the Classic Rock 92.9 KISM before the prize will be transferred to the winner. The e-tickets will be transferred to the winner by Classic Rock 92.9 KISM or, in some cases, by a third party (for example, Ticketmaster, Live Nation, etc.) and the winner must check his or her email account for an email or cellular mobile number for a text message from the ticket provider in order to download the e-tickets. Where e-tickets are a prize, as a condition of entering the contest, redeeming and using e-tickets requires the winner (i) to have a valid email address and an app-enabled mobile device capable of downloading and running a third-party mobile ticketing app (e.g., Ticketmaster, Live Nation, etc.); (ii) to install, or have already installed, such mobile ticketing app on their app-enabled mobile device; and (iii) to log into an existing user account or sign up for a free user account with the third-party operating such mobile ticketing app by completing a form with all required information, including, at a minimum, the winner's first name, last name, valid email address and telephone number. E-tickets awarded as a prize in such contests cannot be redeemed or used by any means other than the designated third-party mobile ticketing app for the e-tickets. Individuals who do not have a valid email address, access to an app-enabled mobile device and/or do not comply with these requirements will not be able to redeem or use e-tickets should they be selected and verified as a winner, will not receive a substitute prize, and should not enter contests where e-tickets are the prize.
  11. Classic Rock 92.9 KISM reserves the right to disqualify any entrant if any contest rules are violated in any way.
  12. Classic Rock 92.9 KISM assumes no liability for situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. Classic Rock 92.9 KISM, its advertising agencies, affiliates, contest sponsors, employees, and immediate families of each are absolved and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest.
  13. As a licensee of the FCC and a trustee of the public airwaves, Classic Rock 92.9 KISM reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of Classic Rock 92.9 KISM management if world events, the national mood, or public safety so warrant.
  14. Classic Rock 92.9 KISM reserves the right to amend the rules to any contest at any time. Classic Rock 92.9 KISM's decision is always final. In the event any one of the general contest rules which govern all Classic Rock 92.9 KISM contests contradict with any specific contest term, the specific contest term will control.
  15. For any contest requiring phone entry you must use only the following number unless otherwise specified: 360-733-5476. For texting it is 360-733-5476. The person processing inbound calls and/or texts at Classic Rock 92.9 KISM has the final decision as to who is the winning entrant.
  16. Classic Rock 92.9 KISM shall have no responsibility for contestant’s inability or failure to participate, failure to win or claim any prize based on malfunction or difficulties with telephone, cell phone, texting, email, mobile applications, internet access, or any other circumstances in any contest beyond Classic Rock 92.9 KISM’s control.
  17. For any contest involving on-line voting: If an entrant receives irregular votes, including but not limited to, votes generated by a robotic, programmed, script, macro, or other automated means, Classic Rock 92.9 KISM reserves the right to disqualify the entrant in its sole discretion and/or use another means to determine the winner(s), ex. – random selection or appointing a panel of judges.
  18. For any contests involving tickets to live performances or events, winners will need to follow all health and public safety guidelines and protocols put in place by the concert organizer.
  19. Classic Rock 92.9 KISM is not responsible for any event cancellations or reschedules.
  20. Classic Rock 92.9 KISM is not responsible for:
    • internet crashes or slowdowns caused by network congestion
    • viruses
    • sabotage
    • satellite failures
    • phone line failures
    • electrical outages
    • natural or man-made disasters
    • lost, late, misdirected, postage-due, unintelligible, returned, or undelivered entries or email
    • lost, interrupted, or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other internet connections, providers, or platforms
    • failed telephone, satellite or cable hardware or software or lines, or jumbled, scrambled, delayed, or misdirected transmissions
    • computer hardware or software malfunctions, failures, or difficulties
    • other errors of any kind whether human, mechanical, electronic, or network

    Persons who tamper with or abuse any aspect of this contest or website, or act in violation of the official service, as solely determined by the station, will be disqualified. Neither sponsor nor promotion parties are responsible for any incorrect or inaccurate information whether caused by website users, tampering, hacking, or by any of the programming or equipment associated with or used in this contest, and assume no responsibility for any errors, omissions, deletions, interruptions or delays in operation or transmission or communication line failure, theft or destruction or unauthorized website access.

    Classic Rock 92.9 KISM is not responsible for injury or damage to participant’s or any other person’s computer or property related to or resulting from participating in this contest. Should any portion of contest be, in Classic Rock 92.9 KISM’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention (i.e., hackers) or other causes which, in the sole opinion of the station, corrupt or impair administration, security, fairness or proper play of this contest, or contest plays, Classic Rock 92.9 KISM reserves the right at its sole discretion to suspend, modify or terminate the contest.

  21. Classic Rock 92.9 KISM has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on prize (if any) are provided only by the manufacturer, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.
  22. The following are specifically related to E-contests and E-Mail Club promotions on kism.com:
    1. All appropriate information in required fields must be entered correctly and completely or you will be disqualified.
    2. To win a prize you must reside within the listening area of Classic Rock 92.9 KISM as defined at the exclusive discretion of Classic Rock 92.9 KISM management.
    3. Any problems with the internet or email are not Classic Rock 92.9 KISM’s responsibility.
    4. Contestants who register to participate on our website may be required to produce a printed copy of proof of registration before being allowed to participate in the contest.
    5. Due to the nature of our programs that are heard on-line over the internet, contests may not be heard at all on Classic Rock 92.9 KISM. Contests heard on the radio station’s internet audio stream may be slightly delayed from the time the contests are heard on the broadcast station, and will be running behind the broadcast signal. Thus, all contests heard on the internet are delayed. This delay can last for as much as 30 seconds or more. This means that when Classic Rock 92.9 KISM contests are played that require a specific caller to telephone the radio station (such as “Caller number 9 when you hear the sound effect”), listeners to the on-line audio stream may be at a disadvantage in participating over those listeners who hear the contests on-air.
